In April 2014, EPA and the U.S. Army Corps of Engineers began seeking public comment on a rule which proposed to define “Waters of the United States”, bringing waters thus defined under federal jurisdiction relative to Section 404 (dredge and fill permits) and 402 (pollutant discharge permits) of the Clean Water Act. No other water rule in recent memory has stirred as much passion and controversy on both sides of the argument. Over one million comments were received on the proposal. This presentation will explore the benefits and limitations of the proposed rule from the perspective of Utah’s water quality agency, offer suggestions on how the rule may be improved, and present the practical effects of federal jurisdiction in how the quality of Utah’s waters is protected.
